Scott Brady recently joined chambers having previously practiced predominantly in Scotland where he has taken silk. Originally a civil practitioner, he now appears mainly in crime. However, he retains some non-criminal work notably in licensing and advising in property matters, having a particular interest in planning.
He has led in prosecutions and for the defence in murders, drug importations and many other heavyweight matters. With a particular interest in art crime he successfully led for the crown in a case of theft of some Rennie Mackintosh chairs from the Glasgow school of Art and latterly his work as a silk in Scotland has involved fraud and financial crime. Since joining Chambers he has built on these foundations having been instructed in a wide range of matters both for prosecution and defence.
He recently led for the defence in a successful challenge to DNA evidence overturning the 1988 rape conviction of a Scottish policeman. Notably, he has appeared in an appeal resulting in a restriction to the scope of the Proceeds of Crime legislation north of the border and was instructed in some of the earliest human rights cases in both his criminal and non-criminal practice, for example, submitting that a gaming licence was protected as a Convention right of property where a licensing authority maintained they were bound by the legislation to refuse renewal, the holder having failed to pay Bingo Duty.
Complementary to his general criminal work, he has wide experience in disciplinary proceedings.
