William Saunders discovered that Essex police have been failing to give identifying witnesses the appropriate warning that if they cannot make a positive identification they should say so. This is in breach of Code D. 11. In the circumstances of this robbery case, the discovery led to the exclusion of the ID evidence and subsequent acquittal of the defendant.
Essex police have now re-drafted their pro-forma to remedy the defect that has existed since 2007.
