John Femi-Ola has successfully represented a defendant at Woolwich Crown Court charged with an allegation of stranger rape in an hostel.
The main issue was one of consent and an application was made to cross examine the complainant under section 41. The application was successful and after a trial that occupied the court for two weeks, the defendant was acquitted. Applications under section 41 are difficult and rarely successful.
