Tim Forte in successful application to dismiss in Indecent Images case

Tim Forte

Tim Forte has succeeded in an application to dismiss in an Indecent Images of Children case.

Tim had been instructed entirely due to his computer and technology expertise. The case revolved around forensic computing evidence and on the recommendation of the defence expert, Tim was asked to act for the defendant.

After attempts to persuade the Crown to discontinue the proceedings, Tim forced the issue to the point where successive judges gave the Crown deadlines to find further expert evidence to shore up their case – in which CEOPs and the NCA were now fully involved. Finally, Tim persuaded the Court to refuse the Crown's applications for an adjournment and an amendment to the indictment. This led to their unsuccessfully seeking an interlocutory appeal to the Court of Appeal and refusals as terminatory rulings and ultimately to the Crown offering no evidence, and a verdict of not guilty being entered.

Tim was instructed by De Maid Solicitors, Cardiff.
