Tom Cockroft successful in the Court of Appeal

Tom Cockroft

Tom Cockroft successfully appealed against his client's conviction for robbery on the basis of a misdirection on joint enterprise in the judge's summing up.

The appellants dragged the complainant onto a golf course on a freezing winter's night, forced him to strip naked, beat him with a pole and threw him into a canal.

The appellants were convicted of false imprisonment, ABH and robbery (of a mobile phone) but the Court of Appeal quashed the robbery conviction on the basis that the judge had misdirected the jury as to the scope of the joint enterprise.

The appellant's overall term was therefore reduced from 6 to 4 years, resulting in his immediate release.
