Beverley successfully advanced a submission of no case to answer on behalf of a defendant charged with making indecent images of children. The application followed effective cross-examination of the prosecution’s digital forensic expert, who ultimately conceded that it could not be established, with any degree of certainty, that the defendant had knowledge of or accessed the images discovered on his devices, which were by that stage inaccessible. The court accepted that a jury properly directed could not properly convict on the evidence and directed a verdict of not guilty.
