Clare Dowse has succeeded in persuading the Court of Appeal to reduce her client's sentence by a quarter in respect of serious child sex offences.
In a case arising from the nationwide Operation Viking investigation, her client had pleaded guilty to offences under s10 of the Sexual Offences Act 2003 and of possessing indecent photographs. The s10 offences were all committed remotely, with Clare's client being in Essex and the victim outside the jurisdiction.
Clare successfully argued that, although at first glance the offending fell into category 1A of the relevant Sentencing Guidelines, on the facts the sentencing judge had failed to have sufficient regard to the fact that her client and the victim were only ever in remote contact.
