John Femi-Ola KC and Jodie Hitchcock were instructed on behalf of the first of three defendants accused of manslaughter.
It was alleged that the deceased had sustained a fracture to his ankle during a fight in the West End of London. The Crown’s case was that the first defendant and his two co-defendants who were passers-by had jointly used unlawful violence against the deceased resulting in the injury to his ankle. A number of weeks later the deceased suffered a blood clot from the fracture and unexpectedly died. The defendants were originally charged with his murder but thereafter faced a count of manslaughter.
Expert evidence served on behalf of the first defendant called into question the issue of when and how the fracture was sustained.
Following a review of all of the evidence in the case the Prosecution conceded mid-trial that they were unable to prove causation. On the trial judge’s direction the jury returned Not Guilty verdicts.
