Katie Porter-Windley, instructed by Coomber Rich, represented a client at Winchester Crown Court for a six day trial. Katie made a successful submission of no case to answer in respect of the ABH at the close of the Crown’s case, arguing that no evidence of actual bodily harm had been adduced, and further successfully adduced non-defendant bad character in respect of providing context of the complainant shoplifting which contradicted her account, and previous allegations made about the defendant by the same complainant that had been dismissed by the Police. The remaining counts were left to the jury, who unanimously acquitted on the indictment. The jury went on to consider the statutory lesser alternative of s.2a stalking, after having a majority direction passed and deliberating for over 7hours, convicted the defendant on the lesser alternative on a factual basis of only two days of low-level conduct, on an 11-1 majority.
