Jonathan Rosen successful on appeal against sentence on fresh ground relating to indication for guilty plea

Following the unavailability of original counsel, Jonathan Rosen was instructed the night before a hearing in the Court of Appeal to appear and present the appeal against sentence. Having spoken with the appellant on video link moments before the hearing, Jonathan identified a ground not pleaded for which he sought leave to appeal out of time.

Time was granted to make further enquiries and following written submissions, the appeal was allowed on the new ground reducing the appellant's sentence for his involvement in a large scale drug supply conspiracy by over a year from 10 years and six months to 9 years and 4 months.

In giving judgment the Court of Appeal said "we have considered the point. It is arguable and raises a procedural point of some practical significance. We grant permission to appeal and we grant an extension of time to advance the appeal".
