Prosecution offer no evidence four weeks into trial of James Wing and Samantha Ball’s client in financial regulation case

James Wing led Samantha Ball in representing a Defendant for trial in respect of an allegation of contravening the general prohibition on carrying out a regulated activity contrary to section 23(1) of the Financial Services and Markets Act 2000 s. 23 (1). In essence, the prosecution alleged that their client had given financial advice by way of business in the context of a fraudulent spread betting organisation.  

The witnesses were cross-examined and expert witnesses gave evidence during the four weeks at Lincoln Crown Court. At the end of the prosecution case, the Crown offered no evidence against their client before the defence had an opportunity to make a submission of no case to answer.
