Siobhan Cawkwell, instructed by Dr Tahir Wasti of LaWise Solicitors, successful in application to dismiss after Voir Dire.

Siobhan successfully argued multiple breaches of PACE Code C, predominantly, the lack of police caution which rendered the confessions unreliable. As those confessions were put to the defendant in interview, the interview should also be excluded. Siobhan argued that admission of this evidence would be so prejudicial that the defendant would not get a fair trial.

The Judge accepted Siobhan’s submissions and excluded the evidence. As a result, the application to dismiss was successful and the Judge dismissed both counts on the Indictment. Having spent 7-months on remand, Siobhan’s client was immediately released from custody.
