Stephen Garbett successfully secures the acquittal of his client on charges of sexual assault by penetration of a 10 year old

Stephen Garbett, instructed by Rachel Buck of Fisher & Co Solicitors, made a successful submission of ‘no case to answer’ after the start of the defence case and the Judge directed the jury to formally record not guilty verdicts. The acquittal of this 25 year old man of good character, brings to an end 3 years of anxiety since the allegations first came to light; the alleged incident itself occurred more than 4 years earlier when his client was just 18 years old.  A key witness in this case had been a prosecution witness until the first day of trial when tendered to the defence.

Hayley Campman of Fisher & Co. assisted in confirming the newly tendered witness’s evidence, obtaining the relevant exhibits and compiling a defence bundle at very short notice in order to demonstrate that the alleged incidents could not possibly have happened.
