Tim Forte and Will Glover publish an article for the International Bar Association Business Crime Committee on Legal Professional Privilege in corporate investigations.

Tim and Will were today published in the IBA Business Crime Committee on the subject of Legal Professional Privilege. The article was written and submitted before the recent ENRC judgment was handed down and was prescient in indicating a number of problems with the reasoning of the High Court decision. In particular in highlighting the deterrent effect that the High Court decision would have had on corporate investigations. In addition the article highlights the potential injustice arising from a restrictive interpretation of when litigation is said to be in reasonable contemplation in a criminal context.
