Tim Forte KC instructed privately by Miriam Altaf at Sperrin Law successfully applied to dismiss charges of assault against a prominent local businessman at Harrow CC on the basis of the weakness and inadmissibility of the purported identification evidence. The Learned Judge agreed with Tim’s analysis of the Turnbull, Daley and Fergus caselaw. In addition, the Judge accepted the relevance of the breaches of PACE (relying on MacMath 1997 WL 1103106), involving the failure to adhere to the ACPO Guidance on Internet Social Media and Identification Procedures. Lastly, the Learned Judge agreed that the purported social media identification was hearsay and thus inadmissible (relying on Bracher [2023] EWHC 3500 (Admin).
