Tom Cockroft successful in extradition appeal raising novel point on non-punishment of victims of trafficking

In SNT v District Court of Sosnowiec, Poland [2024] EWHC 3349 (Admin), the Appellant, an asylum seeker in this jurisdiction, submitted that extradition to Poland would be incompatible with his rights under Articles 4 and 8 of the ECHR on the basis that he had been trafficked from Vietnam to Poland and – in a novel point of general importance to extradition requests – that Poland did not sufficiently protect victims of trafficking from the risk of prosecution in breach of the Council of Europe Convention on Action against Trafficking in Human Beings.

Tom Cockroft was instructed by the CPS Extradition Unit.
