Beverley Da Costa successful in the Court of Appeal in the case of R v C. The appeal was against the imposition of an immediate custodial sentence for a wounding offence where the victim’s ear was nearly severed. The Court agreed with the submission the sentencing judge had failed to properly consider the guidance for the imposition of suspended sentences, and that the decision not to suspend fell outside the range of answers to which the judge could properly have come.
